		<description>How does 2640 come into play if one spouse used his separate funds prior to marriage for downpayment on home but is keeping the property in divorce settlement.  Is he still entitled to the money as separate property?  This seems like double dipping.

		<description>David Borges was a dear friend of mine who struggled with illness for a number of years but never let that struggle keep him from helping others and making life better for his large and wonderful family, his friends who will miss him deeply, and the legal community which he served tirelessly for decades.  He was a great President of our organization in 2001 and implemented many changes in the way the board operated.  He brought a comeraderie and energy to the board that had been lacking for a long time. He led the way to meet the challenges of the 21st century in a realistic and approachable way.  He was always fun to be with, whether on the many committees on which we served together or having fun at a social event.  My heart goes out to Theresa and their children and grandchildren, for I know how much he will be missed.  And, lest it be forgotten, I want to remind all of us who knew him and Theresa how beautifully they made their life together work and how much Theresa was there for David during the last several years without complaint or suspician of tiredness or despair.</description>

		<description>I am just working up this case for one of our CEB pubs, and, as usual, you can be surprised when you go and actually read the statute.  It is clear (as I must confess it was not to me before) that only an &lt;em&gt;innocent&lt;/em&gt; spouse can be awarded support or attorney fees, but this limitation is not expressed with regard to the division of property in the event &lt;em&gt;either&lt;/em&gt; of the parties had a good faith belief in the marriage.  Perhaps the reason this hasn&#039;t come up for appellate review before is that it might normally be the meretricious spouse who acquires the property?</description>

		<description>Sunday morning at the Spring Seminar. I am listening to the Trial practicum on transmutation and other property issues. With the judge&#039;s panel input, Peter Walzer and Chris Melcher are giving an excellent  and practical presentation. This year&#039;s Spring Seminar has been a wonderful experience; the venue is fabulous (who arranged for the PERFECT weather??) and the seminar segments are extremely informative and NOT BORING. I am meeting many family law attorneys who have never attended one of our seminars and the collegiality is wonderful. If you missed it this year, don&#039;t make the same mistake next year.</description>
