Privileges protect certain communications and other information from disclosure, and are a fundamental part of our justice system. This program will cover the most commonly used privileges — including the attorney-client privilege, the marital/spousal privilege, the physician-patient privilege, and the psychotherapist-patient privilege — and their application in family law proceedings. We will discuss the basis for and the scope of these privileges, who holds the privilege, and how an inadvertent waiver can occur. The program will also address the right to privacy and how it differs from a privilege.
